    I thought I would stare a rants and raves topic for all those little things we want to get off our chest or think needs to be changed.

    My first issue is the District Court Kaneohe Division who handles traffic offenses and violations for Kailua.  I just received a notice for default judgment because apparently I had a traffic offense that I failed to respond to. (parking ticket in the Kailua lot)  This is not the first time I have heard about this when it comes to this lot  Besides the complaints I here about the meter police.  (I saw on my doctors website that he described their tactics as AGRESSIVE) it seems to be a common issue where people get these judgments about tickets they never knew they had.

    The issue I have with this, (besides the fact that we never seem to get any previous notices including the ticket!!)  is the huge amount of time and resources that is being wasted for a $35.00 ticket.  It doesn't seem to be efficient.  The administrative cost, the paper and postage that is wasted, the legal fees...by the time they are done are they even making any money?  It just seems that they need to come up with a better system that is more cost efficient.  In Colorado, they use the booting system but they wait until you have $250 worth of tickets.  Now in one aspect, it seems that they are letting people slide for longer but when  you get a boot it costs you not only what you owe but a fee to have the boot removed.  Most people get one and then learn their lesson and pay their tickets on time. And if they don't, the state gets a fee to covers their cost. Nothing is worse then getting a boot and not being able to use your car until you pay your tickets.

    For any business owners:
    Have you ever wondered why at the end of the year on 'paper' or on the 'books' you show a profit and yet you are cash poor?  I have wondered about this for years and have asked many CPAs and not one could give me an answer that made sense. FINALLY, I have discovered WHY.  Is anyone interested in knowing why? hmmm... The answer will 'blow you away' - it did me!

    Ok, Here is the scoop on zero cash flow YET showing profit on the books.

    If it is not hiding in your inventory or savings (ha!) then WHERE is it???

    It turns out to be the Principal on loans that businesses pay back to the banks,...huh? how so  you ask?

    When businesses go to the bank to borrow money to fix up or build a store...that money gets posted under "leasehold improvements".  The IRS has made a law that says that you can only depreciate "leasehold improvements" over 39 years.  BUT businesses must pay back the banks in 5 to 7 years (or however long your lease is).  So any principal that is over the allotted 39 year depreciation goes right to the bottom line as profit!
    Example: $100k has about $90. a year depreciation. The usual principal on $100k on a typical 5 year loan is averaged $20K a year.  That means the difference will show up as profit (unless offset by other losses or expenses-but who has an addition $19,900 in expenses when cash flow shucks!). AND then business pays TAX on that profit, right?   WOW!

    The IRS in the 1980's had Depreciation set at 15 years, if I recall.  Then in the 90's it went up to 31 years - today it is set at 39 years!  Every year that the IRS adds to depreciation makes billion of dollars for them...

    SO, if you are a small business that is looking to borrow money to fix up your office or store, try NOT to list monies in "leasehold improvements"...try putting some in office equipment or fixtures...these have a more reasonable depreciation rate...for now at least.

    Does this make any sense?

    What is the status of the Kailua sign? It looks terrible!

    The Kailua Urban Task Force website said the sign will be moved to the medial strip. When?

    What happened to the club and organization emblems?  Why weren't the organizations informed about this? Who is making these decisions without the courtesy to inform all of the clubs that had very expensive emblems on it?

    Who is the Kailua Urban Task Force working with to make these decisions? Or are these the decisions of a few without community input?

    626 Kaulani Way.. They will not turn their music down even if an officer comes by. As soon as they leave, it is back up. Is there anything anyone can do about this? I know that others in the neighborhood are very annoyed by this because you can hear it a block away and officers have even been there twice in a day after I called to complain about it. As soon as the officer leaves, the tenant turns the music back up just as loud. I am trying to find out who I can talk to regarding this issue because they should be fined or evicted due to causing public disturbance to the entire neighborhood. I want this issue solved soon because the entire neighborhood should not be disturbed because of one house and the police officers do not seem to be enforcing the law very well.

    Thank you for your complaint.  We have a member of the Kailua Police Department on our board and will be sure to pass this information along to him!

    Parking in Kailua
    What is the status of parking on the residential streets in Kailua?  From my understanding the area in front of houses (say about 6 feet from the road) can be used for parking as long as it's not blocking a driveway.  But many of our residents seem to think they own that area and place trees, rocks, or no parking signs.  I have also heard the area was intended for sidewalks and you can't park there.  There is either an extreme lack of parking, or next to no enforcement of what appears to be residents clearly taking over public land.  ould ever dream of placing rocks in the street to prevent people from parking there.  Can someone provide real legal clarification on this issue?
